There are two types of custody over minor children in family proceedings, legal custody and physical custody. Legal custody deals with legal decisions pertaining to the minor child, such as health and education. Physical custody, on the other hand, deals with the primary residence of the child. The standard that the Court’s look to in determining child custody is “Best Interest of the Child”. This factor is determined based on a number of factors, primarily the health, safety, and welfare of the child. Like child support, child custody can always change by obtaining a Court Order.
